KUALA LUMPUR : Bekalan ikan untuk rakyat di utara tanah air terus menyusut 50 peratus berikutan kegiatan mengorek pasir untuk projek tambakan laut di perairan selatan Pulau Pinang (PSR).
 Pengerusi Persatuan Nelayan Pulau Pinang (PEN Mutiara), Nazri Ahmad, berkata ketika ini lebih 14,000 nelayan dari Pulau Pinang dan utara Perak mengadu hasil tangkapan mereka semakin berkurang akibat kegiatan korek pasir dan tambak laut itu.
  “Jika kegiatan ini berterusan kita akan kekurangan sumber protein untuk rakyat malah terpaksa bergantung kepada bekalan ikan yang tidak segar diimport dari luar.
   “Ketika ini lebih dua bilion tan ikan setahun didaratkan, tetapi jumlah itu semakin menyusut hingga satu bilion tan setahun selepas kegiatan korek pasir semakin rancak berlaku.
   “Beberapa laporan polis sudah dibuat membabitkan ternakan hidupan akua mati di Teluk Pahang sehingga jutaan ringgit,” katanya kepada wartawan.
  Pelaksanaan PSR dengan keluasan lebih 1,821 hektar untuk membina tiga pulau buatan di perairan Permatang Damar Laut berdekatan Bayan Lepas memerlukan 189 juta meter padu (m3) pasir.
  Bagi memenuhi keperluan itu kegiatan korek pasir akan membabitkan keluasan 818 kilometer persegi pasir khususnya di utara Perak. 
  Dalam pada itu, kegiatan kecurian pasir juga berlaku untuk memenuhi keperluan projek berkenaan.
   “Kegiatan korek pasir, curi pasir sukar untuk dibuktikan tetapi kita boleh lihat kesannya, contohnya ekosistem musnah, hidupan laut mati, ternakan ikan mati, kawasan darat semakin mengecil contohnya Pulau Korea hilang jika dilihat dari jambatan Pulau Pinang.
   “Projek PSR dijangka mengambil masa sehingga 50 tahun dan kita akan menyaksikan kemusnahan alam dan hidupan laut yang dahsyat di negara ini,” katanya.

Kita kena insaf kerajaan itu cerminan diri kita sendiri. Oleh itu kalau kita nak buat perubahan kena sabarlah. Tak boleh serta merta dapat kerajaan yang baik. Buat sementara itu kita terimalah kerajaan yg tak berapa cerdik, tak berapa bersih dan tak berapa betul. Kita kena sabar dengan kekurangan itu kerana kekurangan kerajaan itu adalah kekurangan kita sebagai rakyat. Kita kena perbaiki diri kita sedikit demi sedikit kalau kita nak kerajaan kita jadi lebih baik. Memperbaiki diri itulah amal kebajikan dan mujahadah. Ia memerlukan kesabaran dan masa yang panjang. Tapi ramai yg tak sabar dan lebih suka ikut hasutan syaitan. Maka siang malamdia hanya berfikir nak menjatuhkan kerajaan, sehingga lupa memperelokkan diri dan masyarakat sedangkan itulah caranya kalau sungguh kita mahukan kerajaan yang elok.

PETALING JAYA: Presiden PKR Anwar Ibrahim mengeluarkan kenyataan pertamanya hari ini sejak kehilangan peluang memegang jawatan tertinggi kerajaan kepada Muhyiddin Yassin, mengingatkan rakyat bahawa kekayaan negara “tidak boleh dirompak oleh segelintir individu”.

Anwar, yang merupakan bakal perdana Menteri di bawah pemerintahan Pakatan Harapan, juga menggesa mereka mengambil “jalan yang tegas mengikut landasan perjuangan kita” dan mengukuhkan keadilan untuk melindungi hak rakyat.

“Kami diberi peluang untuk bersekongkol dengan kelompok lama yang telah merosakkan negara kita, kita memilih untuk kekal dengan prinsip, yang meninggalkan kita, mengkhianati amanah perjuangan kita,” katanya dalam video 2 minit yang dipaparkan di Facebook hari ini.

“Saya ada dengar dan dapat menghidu apa yang sedang direncanakan dan mengkhianati perjuangan kita, termasuk keadilan, menolak rasuah dan penyalahgunaan kuasa,” katanya.

Anwar juga berkata walaupun hak istimewa orang Melayu dan Islam tidak dipertikaikan, Malaysia sebagai negara yang terdiri daripada pelbagai kaum dan agama, maka ia mesti merangkul semua kaum dan agama.

Tambahnya, ekonomi negara tidak harus menghalalkan rompakan oleh segelintir penguasa tetapi memastikan ia dipacu dengan lebih laju dan meyakinkan tetapi menjamin mengagihan yang saksama.

“Petani, nelayan, pekerja, penjawat awam, terutamanya di peringkat menengah dan rendah sedang mengalami masalah dan tekanan hidup,” katanya.

Oleh itu, katanya, rakyat tidak membiarkan kekayaan negara terus dirompak oleh segelintir individu.

Appeals pending, don’t sign ‘3 islands’ deal yet, Penang govt told

GEORGE TOWN: Two groups today told the Penang government not to be too eager to sign agreements related to the three islands project as there were pending legal challenges from NGOs and fishermen.

The Consumers’ Association of Penang (CAP) and Sahabat Alam Malaysia (SAM) said the reclamation work, despite obtaining approval, was under appeal and hence there should be no signing of agreements to formally kickstart the project.

This was after Penang Chief Minister Chow Kon Yeow had reportedly said the government would be signing an agreement to begin reclaiming the 1,821ha Penang South Islands (PSI) project this month.

In a statement, CAP and SAM said the fishermen’s unit of Sungai Batu – which is directly affected by the PSI – had filed an appeal against the approval given by the Department of Environment (DoE) to carry out reclamation work in July last year and that the suit had yet to be heard.

The fishermen have challenged the environmental impact assessment for the PSI, calling it “premature” as it was not compatible with conditions set by the agriculture ministry and that it undermined Malaysia’s obligations on the Convention on Biological Diversity, the statement said.

“These are substantial grounds and the matter could be litigated right up to the Federal Court and could take many months,” CAP’s Mohideen Abdul Kader and SAM’s Meenakshi Raman said.

Under the environmental quality (appeal board) 2003 regulations, a person directly affected by a project can apply to the DoE to reconsider its approval.

“The state government is proceeding as if all approvals will be given and any legal challenge to its project will be decided in its favour regardless of objections by interested parties like the Sungai Batu Fishermen Unit and civil society organisations.

“This makes a mockery of civil society participation in decision making on public matters and the legal process to ensure environmental protection and social justice,” they said.

CAP and SAM also urged the transport ministry not to give final approval to the RM8 billion Bayan Lepas Light Rail Transit (LRT) project in view of its exorbitant cost compared with other cheaper alternative modes of transport, and the financial burden the present and future generations would have to bear.

The PSI involves the creation of three islands to finance the RM46 billion Penang Transport Master Plan, which includes an LRT line, highways and other modes of public transport

Macamlah geng yg satu lg tu takkan kencing.🐮 Rakyat lupa yg pemimpin itu adalah cerminan rakyat. Kalau pemimpinnya kuat kencing maka ia menunjukkan rakyatnya pun begitu….mereka sukakan kaki kencing. Oleh itu mereka mmg layaklah dikencing2. Kalau rakyat betul2 tak mahu dikencing lagi maka mereka sendiri kena berubah dulu… iaitu berubah jd cerdik ataupun mumaiyiz…. supaya dpt bezakan kaki kencing dari yg bukan.🤔 Dan syarat lain adalah jumlah yg cerdik tu kena cukup utk menggerakkan perubahan. Tapi kalau yg cerdik2 itu pun hanya pikir bagaimana nak gunakan kecerdikannya utk mengencing maka masyarakat akan terus bergelumang dlm air kencinglah. Yaikkk.. Tuii… 😵

After 13-year battle, residents in Penang heritage kampung to get free homes

GEORGE TOWN: Some 400 villagers in one of the last remaining heritage Malay kampungs in Penang can breathe easy as they will be given homes at an apartment project to be built in the next four years.

For more than a decade, the residents at Kampung Mutiara in Batu Ferringhi had battled eviction through the intervention of politicians from both sides of the divide, as the village sits on private land.

The landowner did not offer to build homes for them.

Today, UDA Holdings chief executive officer Mohd Salem Kailany said Putrajaya will help by giving the kampung folk free homes within four years under a “new Kampung Mutiara plan”.

He said the Prime Minister’s Department had invited UDA – a company under the entrepreneur development ministry – to submit a proposal to develop a 2ha site adjacent to the current kampung.

The project would be funded by the federal government through a soft loan to UDA, and the remainder would come from UDA’s own funding, Salem said.

A total of 1,068 housing units would be built, including 400 units of low-cost houses, 166 units of affordable housing and 502 condominium units.

The 400 units of low-cost houses would be given to the Kampung Mutiara villagers, including residents of Kampung Che Ahmad, Kampung Din Bamboo and Kampung Kubur, for free.

“Apa maknanya pembangunan yang menyisihkan orang-orang tempatan. Apakah itu kemajuan dan pembangunan? Pembangunan jenis apa begini sedangkan sedangkan dalam rancangan struktur negeri ada sentuh soal mempertahankan kampung-kampung warisan tapi yang berlaku adalah sebaliknya.

“Sepatutnya pembangunan memberi satu nikmat kepada orang tempatan tapi sekarang pembangunan menyebabkan berlaku penindasan secara halus terhadap orang tempatan dari sudut warisan dan sejarah,” katanya.

Penang Islamic authority turned land into wakaf without heirs’ consent, court hears

GEORGE TOWN: A shariah law expert today told a court here that the takeover of late tycoon Shaik Eusoff Shaik Latiff’s estate by the Penang Islamic authorities was likely illegal as it failed to get consent from the heirs of the estate in the first place.

Islamic law academic Aznan Hasan said the sheer fact that Shaik Eusoff’s heirs had not consented to turn their ancestral land into wakaf, or Muslim endowment, land was reason enough as it was considered against the Shafi’i school of law, which Malaysia practises.

“The land was placed under trust after the death of the donor (Shaik Eusoff). Since it has become the estate of the donor, it should have been given to the rightful heirs.

“Placing the property as wakaf under the Majlis Agama is not valid as there was no wakaf created after the death of the donor. There were no statements from the heirs agreeing that the estate was to be turned into a wakaf.

“Hence, the Majlis has no right or status to hold on to the property and ought to return all the properties to the donor’s heirs who are alive and the rightful trustees,” he told the Shariah High Court today.

He was testifying as the plaintiffs’ witness in a land dispute trial between the heirs of Shaik Eusoff Shaik Latiff and the Penang Islamic Religious Council (MAINPP).

Aznan, who is also Amanah Raya’s shariah committee chairman, also supported earlier testimony by another expert over Shaik Eusoff’s will.

He said the late tycoon’s will, to have his Air Itam land be made wakaf for only 21 years, was not compatible with the Shafi’i school of Islam, where wakaf is given in perpetuity, and not for a limited term.

Aznan said that fact alone disqualifies the status of the wakaf land in the first place.

Earlier in the trial, the prosecution went at lengths to establish that he was a credible authority and expert to comment on matters related to Islamic laws of succession.

Aznan is currently an associate professor of Islamic finance at the International Islamic University of Malaysia and a shariah adviser to over 10 Islamic banks around the world.

Shariah High Court judge Mohd Yunus Mohamad Zin set Nov 27 and 28 to allow MAINPP’s lawyers to prepare to question Aznan and two other experts.

The plaintiffs were represented by lawyers Akberdin Abdul Kader, Yuslinov Ahmad, Rafie Mohd Shafie, Redza Rafie, Ardy Suffian Akberdin and Hafizullah Abdullah.

MAINPP was represented by Mohd Anuar Ahmad, Zainul Rijal Abu Bakar, Mohd Najib Rohim and Mohammad Shafiq Ibrahim.

The suit was initiated by Abdul Shukor PA Mohd Sultan, Syed Idross Syed Hassan Al Mashoor, and Sheik Mohd Jelani Sheik Emam.

They are seeking to reclaim two plots of land covering 6ha in Air Itam.

Shaik Eusoff had willed that the land be held in trust for his descendants, and to be used as wakaf land only for a period of 21 years from the death of his last offspring.

The last of his seven children – a daughter – had died in 1932, so the land was supposed to be returned to the family estate in 1953.

This was according to a 10-page will written in English dated Dec 30, 1892.

The case has been in and out of the civil courts since the late 1990s over an argument that the land was held in trust and not wakaf, as claimed by Muslim authorities. Now, it has come to the Shariah High Court for a resolution.

Shaik Eusoff, who was a Jawi Peranakan with roots in Gujarat, India, was a well-known real estate magnate said to have owned large tracts of land in George Town in the early 19th century.

His descendants are also credited with bringing the boria – Penang’s traditional “parody theatre” – to the state.
